What is a lien?
A lien is a claim for payment registered against the title of a property. It puts the world on notice that the contractor (or subcontractor or supplier) improved the property and therefore has a claim against the property for the amount owed. A subcontractor can register a lien even if the problem is with payment from the contractor, because the owner has benefited from the subcontractor's work.
Who can file a lien?
Anyone that provided services that improved a property or supplied equipment or materials that resulted in an improvement to the property.
How long do I have to file a lien?
60 days (including weekends) since the last date of work completed.
What happens after I file the lien?
Even if a lien is filed correctly, the lien must be "perfected" within 90 days by initiating a court action and registering a certificate against title to the property. This 90-day period can be used to negotiate a proper settlement with the homeowner or contractor. However, if negotiations are not successful and you wish for the lien to remain valid, you must file a court action in the Superior Court within 90 days.
